Types of Philadelphia Car Accidents We Handle
No matter what type of car accident you’ve been involved in, Pagano Law has the experience and resources to handle your case. We’ve successfully represented clients injured in all types of collisions throughout Philadelphia and surrounding areas.
Rear-End Collisions
Rear-end accidents are among the most common types of crashes on Philadelphia’s busy streets and highways. Whether caused by distracted driving, tailgating, or sudden stops in traffic, these collisions can result in serious injuries despite often occurring at relatively low speeds. Whiplash, back injuries, and traumatic brain injuries are common consequences of rear-end impacts. We prove the other driver’s negligence and fight for compensation that covers all your medical treatment, lost wages, and pain and suffering.
Head-On Collisions
Head-on collisions are among the most dangerous and often deadly types of car accidents. These devastating crashes frequently result from wrong-way drivers, drivers who cross the center line, or impaired motorists. The force of two vehicles colliding front-to-front often causes catastrophic injuries including severe brain damage, spinal cord injuries, multiple fractures, and internal organ damage. If you or a loved one has survived a head-on collision, you need aggressive legal representation to secure the substantial compensation necessary for long-term care and recovery.
Side-Impact (T-Bone) Accidents
T-bone accidents commonly occur at Philadelphia’s countless intersections when one driver runs a red light, fails to yield the right of way, or misjudges another vehicle’s speed. Because the side of a vehicle offers minimal protection compared to the front or rear, occupants often suffer serious injuries in side-impact collisions. Broken ribs, internal injuries, head trauma, and pelvic fractures are frequent results. We thoroughly investigate these accidents to prove which driver violated traffic laws and caused the crash.
Multi-Vehicle Pileups
Multi-vehicle pileups on the Schuylkill Expressway, I-95, and other major Philadelphia highways can involve numerous vehicles and result in complex liability issues. Determining who’s at fault when three, five, or ten vehicles are involved requires detailed accident reconstruction and careful analysis. Multiple insurance companies will be involved, each trying to minimize their client’s responsibility. Our experience handling these complex cases ensures all liable parties are held accountable and you receive full compensation.
Hit-and-Run Accidents
Unfortunately, hit-and-run accidents are all too common in Philadelphia. If a driver fled the scene after hitting you, you may feel helpless, but you still have options. We work with law enforcement to help track down fleeing drivers, and we explore your uninsured motorist coverage to ensure you’re compensated even if the at-fault driver is never found. You deserve justice and compensation regardless of whether the other driver stayed at the scene.
Distracted Driving Accidents
The epidemic of distracted driving has made Philadelphia’s roads more dangerous than ever. Drivers texting, using GPS, eating, or otherwise taking their attention off the road cause thousands of preventable accidents each year. We obtain cell phone records, review traffic camera footage, and gather witness testimony to prove the other driver was distracted. Pennsylvania law is clear about the dangers of distracted driving, and we use every available tool to hold negligent drivers accountable.
Drunk Driving Accidents
Drunk driving accidents are entirely preventable tragedies that devastate innocent victims. If you were hit by an impaired driver, you may be entitled to punitive damages in addition to compensation for your injuries. We pursue every avenue for recovery, including potential dram shop claims against bars or restaurants that over-served the drunk driver. These cases send a strong message that driving under the influence will not be tolerated and carries serious consequences.
Rideshare Accidents (Uber/Lyft)
As rideshare services have become increasingly popular in Philadelphia, accidents involving Uber and Lyft drivers have risen accordingly. These cases involve complex insurance coverage issues depending on whether the driver was on a trip, had the app on waiting for a ride, or was off-duty. Uber and Lyft carry substantial insurance policies, but accessing that coverage requires knowledge of their specific requirements and procedures. We’ve handled numerous rideshare accident cases and know how to navigate these unique claims.
Intersection Accidents
Philadelphia’s busy intersections along Broad Street, Market Street, and throughout the city see countless accidents each year. Traffic signal malfunctions, drivers running red lights, failure to yield, and confusion about right-of-way all contribute to these crashes. We investigate the intersection where your accident occurred, review traffic signal records, and determine whether poor road design or inadequate signage contributed to the collision. Every factor matters when building your case.
No matter what type of accident caused your injuries, we can help. Call Pagano Law at (215) 636-0160 today.
Common Causes of Car Accidents in Philadelphia
Understanding what caused your accident is critical to building a successful case. Our thorough investigation will determine exactly what factors contributed to your crash and who should be held responsible. Common causes of Philadelphia car accidents include:
Distracted driving has become the leading cause of accidents on our roads. Drivers texting, programming GPS systems, eating, applying makeup, or engaging with passengers cause thousands of preventable crashes. Even a few seconds of inattention is enough to cause a serious accident.
Speeding is particularly dangerous on Philadelphia’s highways. Drivers racing down I-95, the Schuylkill Expressway, or Roosevelt Boulevard at excessive speeds have less time to react to hazards and cause more severe injuries when crashes occur.
Drunk and impaired driving continues to plague our roads despite increased awareness and strict penalties. Drivers under the influence of alcohol or drugs have impaired judgment, slower reaction times, and reduced coordination, making them a danger to everyone on the road.
Aggressive driving and road rage are common on Philadelphia’s congested streets. Tailgating, weaving between lanes, cutting off other drivers, and other aggressive behaviors dramatically increase accident risk.
Running red lights and stop signs causes devastating intersection accidents throughout the city. Drivers in a hurry or not paying attention blow through traffic signals and cause T-bone collisions with drivers who have the right of way.
Failure to yield right of way occurs at intersections, when merging onto highways, and in numerous other traffic situations. Drivers who don’t yield cause accidents that could have been easily prevented by following basic traffic laws.
Poor road conditions are a significant factor in many Philadelphia accidents. The city’s infamous potholes, uneven pavement, missing lane markings, and inadequate drainage all contribute to crashes. When government entities fail to properly maintain roads, they can be held liable.
Weather conditions including snow, ice, and rain make driving more dangerous, particularly when combined with driver error. While bad weather doesn’t excuse negligent driving, it does require extra caution that many drivers fail to exercise.
Driver fatigue impairs drivers as much as alcohol in many cases. Drowsy driving on long commutes or late at night causes drivers to have slower reaction times and can even lead to drivers falling asleep at the wheel.
Vehicle defects and maintenance failures can cause accidents when brakes fail, tires blow out, or other mechanical problems occur. Both manufacturers and vehicle owners can potentially be held liable when mechanical issues cause crashes.
Our comprehensive investigation will determine the exact cause of your accident and identify all responsible parties.
Common Injuries from Philadelphia Car Accidents
Car accidents can cause devastating injuries that affect every aspect of your life. The force of a collision, even at relatively low speeds, can cause serious harm to the human body. At Pagano Law, we’ve represented clients who have suffered virtually every type of accident-related injury.
Traumatic Brain Injuries (TBI)
Brain injuries range from concussions to severe traumatic brain injuries that cause permanent cognitive impairment. Even “mild” concussions can have long-lasting effects on memory, concentration, mood, and overall quality of life. Severe TBIs can result in permanent disability, personality changes, and the need for lifelong care. These injuries often aren’t immediately apparent, which is why seeking medical attention after any accident is critical.
Spinal Cord Injuries
Damage to the spinal cord can result in partial or complete paralysis. Paraplegia (paralysis of the lower body) and quadriplegia (paralysis of all four limbs) are life-altering injuries that require extensive medical care, home modifications, assistive devices, and long-term attendant care. Even less severe spinal injuries like herniated discs can cause chronic pain and permanent limitations on your ability to work and enjoy life.
Neck and Back Injuries
Whiplash is one of the most common car accident injuries, but it’s far from minor. The rapid back-and-forth motion of the head and neck can cause soft tissue damage, nerve damage, and chronic pain that lasts for months or years. Other neck and back injuries including cervical spine damage and lumbar injuries can require surgery and extensive physical therapy.
Broken Bones and Fractures
The force of a car accident commonly causes broken bones throughout the body. Arms, legs, ribs, the pelvis, facial bones, and other fractures often require surgery with pins, plates, or rods to heal properly. Recovery can take months, and many fractures result in permanent limitations or chronic pain even after healing.
Internal Injuries
Internal bleeding and organ damage are serious, potentially life-threatening injuries that may not be immediately apparent after an accident. The liver, spleen, kidneys, and other internal organs can be damaged by blunt force trauma. These injuries often require emergency surgery and can have long-term health consequences.
Soft Tissue Injuries
Sprains, strains, tears, and other soft tissue injuries affect muscles, ligaments, and tendons throughout the body. While insurance companies often try to downplay these injuries as “minor,” they can cause significant pain and disability. Many soft tissue injuries become chronic conditions that affect your ability to work and enjoy activities for years.
Cuts, Lacerations, and Scarring
Broken glass, twisted metal, and deployed airbags commonly cause cuts and lacerations in car accidents. Facial injuries and visible scarring can cause permanent disfigurement that affects your self-esteem and quality of life. Severe lacerations may require plastic surgery and can leave permanent scars despite treatment.
Psychological Trauma
The psychological impact of a car accident shouldn’t be underestimated. Many accident victims develop post-traumatic stress disorder (PTSD), anxiety, depression, and a fear of driving or riding in vehicles. These psychological injuries are real, compensable damages that deserve recognition and treatment.
Even injuries that seem “minor” at first can have major consequences. Don’t let insurance companies minimize your injuries. Call Pagano Law at (215) 636-0160.
What to Do After a Car Accident in Philadelphia
The steps you take immediately after a car accident can significantly affect your ability to recover compensation. While your first priority should always be safety and medical care, following these guidelines will help protect your legal rights.
At the Scene
Check for injuries. Your safety and the safety of others comes first. If anyone is injured, this becomes the immediate priority.
Call 911. Always contact police and request medical assistance, even if injuries seem minor. A police report creates an official record of the accident, and some injuries don’t show symptoms immediately.
Document everything. If you’re physically able, use your phone to take extensive photos and videos of the vehicles involved, all damage, the accident scene, road conditions, weather, traffic signals, skid marks, debris, and anything else that might be relevant. The more documentation, the better.
Exchange information. Get the other driver’s name, contact information, driver’s license number, insurance company, and policy number. Also get the license plate number and vehicle description. If there are passengers, get their information as well.
Get witness information. If anyone saw the accident, get their names and phone numbers. Ask what they observed. Independent witnesses can be invaluable to your case.
Note important details. Write down or record the time, date, exact location, traffic conditions, your observations about what happened, and anything the other driver says. Memory fades quickly, so capture these details while they’re fresh.
Don’t admit fault. Even if you think you might have contributed to the accident, don’t apologize or accept blame at the scene. Stick to facts when talking to police and other drivers. Anything you say can be used against you.

After Leaving the Scene
Seek medical attention immediately. Even if you feel fine, see a doctor as soon as possible. Adrenaline can mask injuries, and some conditions like internal bleeding or brain injuries may not show symptoms immediately. Seeking prompt medical care also creates a medical record linking your injuries to the accident, which is essential for your claim.
Report the accident to your insurance company. Your policy requires prompt notification. However, be careful what you say. Stick to basic facts and don’t give detailed statements or accept blame. Tell them you’ve hired an attorney and refer them to us.
Keep all documentation. Save every piece of paper related to the accident: medical records and bills, police reports, photos and videos, repair estimates, rental car receipts, and any correspondence from insurance companies. Create both physical and digital copies.
Don’t talk to the other driver’s insurance company. They will contact you quickly, often within hours, trying to get a recorded statement or convince you to settle. They’re not looking out for your interests. Politely decline to give statements and refer them to your attorney.
Call Pagano Law immediately. The sooner you have legal representation, the better we can protect your rights. We offer free consultations and can start working on your case from day one. Call (215) 636-0160 now.
What NOT to Do
Don’t apologize or admit fault at the scene or in any subsequent communications. Leave fault determination to the professionals.
Don’t post on social media about the accident or your injuries. Insurance companies monitor social media and will use your posts against you. Even innocent photos can be twisted to suggest you’re not really hurt.
Don’t give recorded statements to any insurance company without consulting your lawyer first. These statements are designed to get you to say things that hurt your claim.
Don’t accept the first settlement offer. Initial offers are almost always far below what your case is worth. Insurance companies hope you’ll accept quickly before you understand the full extent of your injuries.
Don’t wait to get medical treatment. Gaps in treatment give insurance companies ammunition to claim you weren’t really hurt. Follow all doctor recommendations and attend all appointments.
Don’t wait to call a lawyer. The sooner you have legal representation, the stronger your case will be.

Pennsylvania Car Accident Laws You Need to Know
Pennsylvania has unique car accident laws that significantly impact your case. Understanding these laws is critical to protecting your rights and maximizing your compensation.
Pennsylvania’s Limited vs. Full Tort Insurance
When you purchased your auto insurance policy in Pennsylvania, you made a choice between “limited tort” and “full tort” coverage. This choice dramatically affects your ability to recover compensation after an accident.
What is tort insurance? Tort insurance determines what damages you can sue for after a car accident. Most people don’t fully understand this choice when they buy insurance, but it becomes critically important after an accident.
Limited Tort coverage allows you to sue for economic damages like medical expenses and lost wages, but restricts your ability to sue for non-economic damages like pain and suffering unless you meet the “serious injury” threshold. People choose limited tort because it offers lower insurance premiums, but it can severely limit compensation after an accident.
Full Tort coverage allows you to sue for all damages including pain and suffering, loss of enjoyment of life, and other non-economic damages, with no restrictions. While it costs more in monthly premiums, it provides much more protection if you’re injured.
The “Serious Injury” Exception to limited tort allows you to sue for full damages if you suffered death, serious impairment of a body function, or permanent serious disfigurement. We can help determine if your injuries meet this threshold.
Why this matters: The difference between limited and full tort can mean tens or hundreds of thousands of dollars in your compensation. We’ll review your insurance policy and explain exactly what coverage you have.
Statute of Limitations
Pennsylvania law gives you two years from the date of your car accident to file a lawsuit. The clock starts ticking on the day of the accident, and if you miss this deadline, you lose your right to sue forever, with very few exceptions.
Why you need to act now: Evidence disappears quickly. Witnesses move away or forget details. Medical records get lost. Surveillance footage gets deleted. Physical evidence like skid marks fade. The sooner we start working on your case, the stronger it will be.
Exceptions are rare. While there are limited exceptions for minors or cases where injuries weren’t discovered immediately, you should never count on these exceptions applying to your case. The safest course is to contact an attorney as soon as possible after your accident.
Comparative Negligence in Pennsylvania
Pennsylvania follows a “51% bar rule” for comparative negligence. This means you can recover damages as long as you’re 50% or less at fault for the accident. If you’re found to be 51% or more at fault, you cannot recover anything.
How it works: If you’re found partially at fault, your compensation is reduced by your percentage of fault. For example, if you’re awarded $100,000 but found to be 20% at fault, you would receive $80,000.
Insurance companies exploit this rule. They will aggressively try to shift blame to you to reduce what they have to pay. Even if their driver clearly caused the accident, they’ll look for any way to claim you contributed to the crash.
Why legal representation matters: We fight back with evidence that proves the other driver’s negligence and minimizes any blame assigned to you. Our thorough investigation and skilled advocacy can make the difference between recovering full compensation and receiving nothing.
Pennsylvania No-Fault Benefits (First-Party Benefits)
Pennsylvania requires drivers to carry first-party benefits (also called PIP or medical payments coverage) that pay for your medical expenses, lost wages, and funeral expenses regardless of who caused the accident. These benefits are available from your own insurance policy up to the limits you selected.
These first-party benefits are separate from your injury claim against the at-fault driver. You can receive both your first-party benefits and file a claim against the other driver’s insurance.
Uninsured/Underinsured Motorist Coverage
Uninsured motorist (UM) coverage protects you if you’re hit by a driver with no insurance. Underinsured motorist (UIM) coverage protects you when the at-fault driver doesn’t have enough insurance to cover your damages.
This coverage is part of your own insurance policy, but many people don’t realize they have it or how it works. We regularly pursue UM/UIM claims for our clients, especially in Philadelphia where uninsured drivers are unfortunately common.
Understanding these laws is complex, but we make it simple. Call (215) 636-0160 for a free consultation.
When I say effective and thorough, I mean it. I procured Greg’s services to assist my nephew with a case. First, Greg and team makes every effort to make effective counsel available to those in need. Their flexibility regarding payment readiness and payment plans was very comforting and a relief. Greg not only provided advice as counsel but as a family friend, as such he gave our family the strength to fight those charges as well. Greg did not steer us wrong. My nephew was found not guilty of all charges and was able to walk away from the whole experience with peace of mind. Thank you to the Pagano team and specifically Greg for being just what our family needed effective counsel, a sense of compassion and understanding, and a fighter of justice for all. Thank you.
I was recently accused of something I did not do, and there was no evidence to support the accusation. It was an incredibly stressful situation, and Greg was exactly the person I needed. He took my call late on a weekend, immediately calmed me down, and guided me step by step through what to do next.
Greg was clear, steady, and reassuring throughout the entire process. He explained everything in a way that made me feel informed and protected, not overwhelmed. Having him in my corner made all the difference.
I truly cannot recommend anyone more highly. If you are ever accused of something or find yourself in trouble and need someone you can trust, Greg is the person to call. There is no one I would trust more.
What Compensation Can You Recover After a Philadelphia Car Accident?
We fight to maximize every dollar you deserve. The compensation available in car accident cases depends on the severity of your injuries, the impact on your life, and whether you have full tort or limited tort insurance coverage.
Economic Damages (Tangible Financial Losses)
Medical Expenses include every dollar you’ve spent or will spend on accident-related medical care: emergency room and hospital bills, surgery costs, doctor visits and specialists, physical therapy and rehabilitation, prescription medications, medical equipment like wheelchairs or crutches, and future medical care for ongoing treatment or permanent injuries.
Lost Wages compensate you for income you’ve already lost due to the accident. This includes time you missed from work while recovering, sick days and vacation days you had to use, and documented lost income from your employer.
Loss of Earning Capacity applies when your injuries prevent you from returning to your previous job or reduce your ability to earn income in the future. If you’re permanently disabled, can’t perform the same work, or have reduced income potential, expert testimony can establish the value of these future losses.
Property Damage includes the cost to repair or replace your vehicle, personal property that was damaged in the crash, and rental car expenses while your vehicle is being repaired or replaced.
Non-Economic Damages (Intangible Losses)
Pain and Suffering compensates you for the physical pain you’ve endured from your injuries, chronic pain conditions that may last for years, and ongoing discomfort that affects your daily life.
Emotional Distress recognizes the psychological impact of the accident including PTSD, anxiety, depression, fear of driving or riding in cars, psychological trauma, and the cost of therapy and counseling to address these conditions.
Loss of Enjoyment of Life compensates you when injuries prevent you from participating in hobbies you once enjoyed, playing with your children, engaging in sports or recreational activities, or generally reduce your quality of life.
Loss of Consortium recognizes the impact your injuries have on your marriage or relationship. This includes loss of companionship, intimacy, and support. Your spouse can make a separate claim for these damages.
Disfigurement and Scarring addresses the compensation you deserve for permanent visible scars, facial injuries that affect your appearance, and the self-consciousness and embarrassment that often accompany disfiguring injuries.
Punitive Damages (Rare)
Punitive damages are only awarded in cases involving extreme recklessness or intentional conduct, such as drunk driving or deliberately causing a crash. These damages are meant to punish the defendant and deter similar behavior, and they’re awarded in addition to compensatory damages.
Important note: Whether you have full tort or limited tort insurance affects what non-economic damages you can recover. We’ll review your policy and explain exactly what compensation you’re entitled to pursue.
We’ll calculate the full value of your claim. Call for a free case evaluation: (215) 636-0160.

Who Can Be Held Liable for Your Philadelphia Car Accident?
One of the most important aspects of maximizing your compensation is identifying all potentially liable parties. Multiple parties may be responsible for your injuries, and we investigate thoroughly to ensure everyone who contributed to the accident is held accountable.
The Other Driver
The most common defendant in car accident cases is the driver who caused the crash. Their personal negligence—whether speeding, distracted driving, running a red light, DUI, or any other form of careless or reckless behavior—makes them liable for all damages they caused.
Vehicle Owner (if different from driver)
When the at-fault driver doesn’t own the vehicle they were operating, the owner can also be held liable. Pennsylvania law allows for “negligent entrustment” claims when an owner lends their vehicle to someone they know or should know is an incompetent or reckless driver. Additionally, under permissive use laws, vehicle owners are often liable for accidents caused by anyone they gave permission to drive.
Employer/Trucking Company
If the at-fault driver was working at the time of the accident—making deliveries, commuting between job sites, running company errands—their employer may be liable under the legal doctrine of “vicarious liability.” Employers can also be directly liable for negligent hiring, training, or supervision of drivers. Commercial trucking companies carry much larger insurance policies than individual drivers, potentially increasing available compensation significantly.
Vehicle/Parts Manufacturer
When mechanical failure causes or contributes to an accident, the vehicle or parts manufacturer may be liable under product liability laws. Defective brakes, tire blowouts, airbag malfunctions, or design flaws can all lead to manufacturer liability. These cases often involve complex expert testimony but can result in substantial compensation.
Government Entity
Dangerous road conditions, poor road design, missing or broken traffic signals, inadequate signage, and failure to maintain roads can all contribute to accidents. When government negligence is a factor, the responsible municipality, county, or state agency can potentially be held liable. These claims involve special notice requirements and shorter deadlines, so immediate legal representation is critical.
Bar/Restaurant (Dram Shop Liability)
Pennsylvania’s dram shop laws allow you to sue bars, restaurants, and other establishments that served alcohol to a visibly intoxicated person who then caused an accident. If the drunk driver who hit you was over-served at a local establishment, that business can be held liable alongside the driver, potentially increasing your total compensation significantly.
Rideshare Company (Uber/Lyft)
Rideshare accidents involve complex insurance issues that depend on the driver’s status at the time of the crash. If the driver had a passenger, Uber and Lyft’s $1 million liability policies apply. If the app was on but the driver hadn’t accepted a ride, a different policy applies. If the app was off, only the driver’s personal insurance applies. We navigate these complexities to access maximum coverage.
Maintenance/Repair Shop
When improper repairs or negligent maintenance contribute to an accident, the repair shop or mechanic who worked on the vehicle may be liable. If they failed to properly fix known issues, installed defective parts, or made errors that led to mechanical failure, they can be held accountable.
Our thorough investigation identifies all potential liable parties to maximize your recovery. Call (215) 636-0160 today.
How a Philadelphia Car Accident Case Works
Understanding the legal process helps reduce anxiety and allows you to make informed decisions about your case. While every case is unique, most follow a similar path from initial consultation to resolution.
Step 1: Free Consultation
Call Pagano Law at (215) 636-0160 to schedule your free consultation. We’ll listen carefully to your story, review any documents you have (police report, medical records, photos, insurance information), evaluate your case objectively, explain your legal options and what to expect, and answer all your questions. There’s no cost and no obligation—just honest advice about your situation.
Step 2: We Investigate Your Accident
Once you hire us, we immediately begin investigating your accident. We obtain the official police report, gather all medical records and bills, collect evidence including photos, videos, and physical evidence, interview witnesses and take recorded statements, conduct accident reconstruction if necessary, review all relevant insurance policies, identify all potentially liable parties, calculate your damages including future expenses, and build the strongest possible case on your behalf.
Step 3: We Handle Insurance Companies
We report the accident to all relevant insurance companies, but you don’t have to talk to adjusters—we handle all communications. We prevent recorded statements that could be used against you, submit comprehensive insurance claims with supporting documentation, demand full and fair compensation, negotiate aggressively on your behalf, and protect you from bad faith insurance tactics like delay, denial, and lowball offers.
Step 4: Medical Treatment
Getting proper medical treatment is critical both for your health and your case. We help you get the treatment you need by referring you to trusted doctors when necessary. We work with medical providers who understand personal injury cases and often wait for settlement before demanding payment. We document all injuries with thorough medical records, keep detailed records of all receipts and expenses, and ensure you follow all doctor’s orders to avoid giving insurance companies ammunition to minimize your injuries.
Step 5: Demand Letter and Negotiation
Once you’ve completed treatment or reached maximum medical improvement (MMI), we send a detailed demand package to the insurance company. This package includes all medical records documenting your injuries, comprehensive bills and expense documentation, lost wage verification from your employer, photos and other evidence, and a formal demand for full compensation based on all your damages.
We then negotiate with the insurance company through multiple rounds of offers and counteroffers. The vast majority of car accident cases settle at this stage without the need for a lawsuit. We keep you informed throughout negotiations and provide our professional recommendation about whether settlement offers are fair.
Step 6: Filing a Lawsuit (If Necessary)
If settlement negotiations fail to produce a fair offer, we file a lawsuit in the Philadelphia Court of Common Pleas. Filing suit preserves your rights before the statute of limitations expires, shows the insurance company we’re serious about going to trial, and often motivates them to make better settlement offers. The complaint is filed and the defendant is served with notice of the lawsuit, formally beginning the litigation process.
Step 7: Discovery Phase
Discovery is the formal exchange of information between parties. This includes depositions where parties and witnesses give sworn testimony, interrogatories (written questions that must be answered under oath), document requests for relevant records and information, and expert witness disclosures from accident reconstructionists, medical experts, economists, and other specialists. The discovery process further strengthens your case by gathering additional evidence and locking in witness testimony.
Step 8: Mediation/Settlement Conferences
Many courts require or strongly encourage mediation before trial. A neutral third-party mediator helps facilitate settlement discussions in a structured setting. Both sides present their case, and the mediator works to find common ground. Many cases settle at mediation because both sides can see the strengths and weaknesses of their positions. We provide candid advice about whether settlement offers are fair and in your best interest.
Step 9: Trial (If Needed)
If no settlement is reached, we proceed to trial. We’re experienced trial attorneys who aren’t afraid to take cases before a judge and jury. We present your case through opening statements, witness testimony, and expert opinions. We cross-examine the defense’s witnesses to expose weaknesses in their case. We present compelling closing arguments that tie all the evidence together. The jury deliberates and reaches a verdict determining liability and damages. Throughout the trial, we fight aggressively to win the compensation you deserve.
Step 10: Settlement or Verdict
Whether through settlement or trial verdict, when money is awarded, the insurance company pays according to the settlement agreement or court judgment. We deduct our contingency fee and case costs (which we’ve advanced throughout the case), and you receive your compensation. Your case is resolved, and you can move forward with your life.
Average Timeline: Most cases settle within 6-12 months. Cases that go to trial typically take 1-2 years or longer. We move as quickly as possible while ensuring we maximize the value of your case. Settling too quickly often means leaving money on the table.

Why You Need a Lawyer to Deal with Philadelphia Insurance Companies
After a car accident, you’re facing professional insurance adjusters whose job is to pay you as little as possible. These aren’t your friends or advocates—they work for corporations focused on protecting their profits, not your wellbeing.
Insurance Company Tactics We Fight Against
Tactic 1: Quick Lowball Offers
Insurance companies often contact accident victims within hours or days with quick settlement offers. These offers are made before you know the full extent of your injuries, before you’ve seen all necessary medical specialists, and before you understand the long-term impact on your life. Once you accept a settlement and sign a release, you cannot come back for more money when you discover your injuries are more serious than you thought. We make sure you receive the full value of your claim, not a fraction of what you deserve.
Tactic 2: Recorded Statements
Adjusters will call asking for “your version of events” or wanting to “clarify a few details.” They’re friendly and sympathetic, making it seem harmless. But these calls are recorded, and adjusters are trained to ask questions designed to get you to say things that hurt your case. They’ll twist your words, take statements out of context, and use your own words against you to deny or minimize your claim. We handle all communications so this can’t happen.
Tactic 3: Delay and Frustration
Insurance companies use delay as a weapon. They’ll drag out the process hoping you’ll get frustrated and give up or accept a low offer just to be done with it. They’ll claim documents were “lost” and ask you to resubmit them. They won’t return calls. They’ll request information they’ve already received. These tactics are designed to wear you down. We keep constant pressure on insurance companies and don’t let them delay your claim.
Tactic 4: Blaming the Victim
Even in cases where their driver is clearly at fault, insurance companies will try to shift some blame to you. They’ll claim you were speeding, distracted, or partially responsible in some way. Under Pennsylvania’s comparative negligence law, if they can assign even 20% fault to you, they reduce their payment by 20%. We prove the other driver’s fault with clear evidence and fight attempts to blame you for the accident.
Tactic 5: Minimize Your Injuries
Insurance companies love to downplay injuries. They’ll call your whiplash a “minor soft tissue injury” even though you’re in constant pain. They’ll claim you had pre-existing conditions. They’ll send investigators to surveil you, hoping to catch you doing something they can use to claim you’re not really hurt. We thoroughly document every aspect of your injuries with medical records, expert testimony, and your own detailed account of how the accident has affected your life.
Tactic 6: Deny the Claim Entirely
Sometimes insurance companies simply deny claims, saying their driver wasn’t at fault, claiming policy exclusions or violations, or asserting there’s no coverage. Often these denials are improper or made in bad faith. We fight claim denials aggressively, and when necessary, we file bad faith lawsuits against insurance companies that refuse to honor their obligations.
Why Having a Lawyer Levels the Playing Field
We speak the insurance industry’s language. We know their tactics because we’ve seen them countless times. We’re not intimidated by large insurance companies or their lawyers. We protect your rights at every stage. We negotiate from a position of strength because insurance companies know we’re willing and able to take cases to trial. When necessary, we do take cases to trial and win.
What We Handle So You Don’t Have To
Once you hire Pagano Law, you can stop worrying about the legal aspects of your case. We handle all phone calls and correspondence with insurance companies, complete all necessary paperwork and documentation, negotiate settlements aggressively and strategically, fight unfair claim denials with legal action when needed, deal with medical liens from hospitals and health insurance, coordinate with your health insurance to prevent double recovery issues, and protect you from making mistakes that could hurt your case.
Don’t face insurance companies alone. They have lawyers working for them—you should too. Call (215) 636-0160.
Why You Should Call a Philadelphia Car Accident Lawyer Immediately
Time is critical after a car accident. The sooner you contact Pagano Law, the better we can protect your rights and build your case.
Evidence Disappears Quickly
Physical evidence like skid marks fade within days. Debris is cleared from accident scenes. Witnesses move away or their memories fade. Surveillance footage from nearby businesses is often deleted after 30-60 days. Vehicle damage gets repaired. The longer you wait, the harder it becomes to gather the evidence we need to prove your case. We preserve everything immediately when you hire us.
Statute of Limitations
Pennsylvania gives you only two years to file a lawsuit, but this deadline approaches faster than you think. Complex cases take significant time to build properly. Investigation takes weeks or months. Medical treatment can last a year or more. Before you know it, time is running out. Don’t wait until it’s too late to protect your rights.
Insurance Companies Are Already Working
From the moment an accident is reported, insurance companies begin investigating and building their defense. They’re gathering evidence, interviewing witnesses, and developing arguments to minimize or deny your claim. You need representation too. The sooner we start working on your case, the better positioned we are to counter their tactics.
Medical Treatment Needs Proper Documentation
Gaps in medical treatment give insurance companies ammunition to claim you weren’t really hurt. If there’s a three-week gap between your accident and your first doctor visit, they’ll argue your injuries must not be serious. We guide you on proper documentation from day one, ensuring your medical records accurately reflect your injuries and their connection to the accident.
Memories Fade
Your own memory of the accident will become less clear over time. Witness recollections blur. Details that seem unforgettable today become hazy months later. Fresh memories equal stronger evidence, which means a stronger case and better results.
Financial Pressure Mounts
Medical bills pile up. You can’t work. Your family is struggling financially. This pressure makes victims vulnerable to accepting inadequate settlement offers just to get money in the door. When you hire us, we relieve that pressure by handling your case on contingency (no fee unless we win) and often helping arrange medical treatment that doesn’t require immediate payment. This allows you to hold out for fair compensation rather than accepting the first lowball offer.
The consultation is completely free. You have nothing to lose and everything to gain. Call Pagano Law at (215) 636-0160 now.
Philadelphia Car Accident FAQ
What should I do immediately after a car accident in Philadelphia?
First, check for injuries and call 911 to get police and medical help on the scene. Document everything you can with photos of all vehicles, damage, the scene, road conditions, and anything else relevant. Exchange information with the other driver including insurance details and contact information, but don’t admit fault or apologize. Get contact information from any witnesses. Seek medical attention even if you feel fine, as many injuries don’t show symptoms immediately. Then call Pagano Law at (215) 636-0160 for a free consultation to protect your legal rights.
How much does it cost to hire Pagano Law?
Absolutely nothing upfront. We work on a contingency fee basis, which means we only get paid if we win your case. There are no hourly fees, no retainer, and no costs to you unless we successfully recover compensation. If we don’t win, you don’t pay. This arrangement allows everyone access to quality legal representation regardless of their financial situation, and it means we’re fully invested in getting you the best possible outcome.
How much is my car accident case worth?
Every case is unique, and the value depends on many factors including the severity of your injuries, the amount of medical treatment required, whether you have permanent injuries or disability, how much work you missed and future earning capacity, property damage, pain and suffering, whether you have full tort or limited tort insurance, and the strength of evidence proving the other driver’s fault. We provide free case evaluations where we can give you an honest assessment of what your case may be worth.
How long do I have to file a car accident lawsuit in Pennsylvania?
Pennsylvania law gives you two years from the date of the accident to file a lawsuit. If you miss this deadline, you lose your right to sue permanently, with very few exceptions. However, you shouldn’t wait until the deadline approaches. Evidence disappears, witnesses become unavailable, and building a strong case takes time. Contact us as soon as possible after your accident to protect your rights.
What if I was partially at fault for the accident?
Pennsylvania follows a “51% bar rule.” You can still recover damages as long as you’re 50% or less at fault for the accident. If you’re found to be 51% or more at fault, you cannot recover anything. If you’re partially at fault, your compensation is reduced by your percentage of responsibility. For example, if you’re awarded $100,000 but found 20% at fault, you’d receive $80,000. Insurance companies will try to shift blame to you, which is why having an experienced attorney is critical.
Do I really need a lawyer for my car accident case?
While you’re not legally required to have a lawyer, the reality is that insurance companies have teams of lawyers and adjusters working to minimize what they pay you. Car accident cases involve complex insurance laws, medical documentation, evidence gathering, and negotiation. Studies consistently show that accident victims who hire attorneys receive significantly more compensation than those who handle claims themselves—even after attorney fees are deducted. We handle everything so you can focus on recovery, and you only pay if we win.
What if the other driver doesn't have insurance?
If you’re hit by an uninsured driver, you can make a claim under your own uninsured motorist (UM) coverage, which is part of your auto insurance policy. Many people don’t realize they have this coverage or how to access it. We help you navigate uninsured motorist claims to ensure you’re compensated even when the at-fault driver has no insurance. Pennsylvania requires insurance companies to offer UM coverage, though you can reject it.
How long will my case take?
Most car accident cases settle within 6-12 months, though complex cases or those that go to trial can take longer. The timeline depends on the severity of your injuries (cases can’t fully settle until you’ve completed treatment or reached maximum medical improvement), the complexity of liability issues, how many parties are involved, whether the insurance company negotiates in good faith, and whether a lawsuit becomes necessary. We move as efficiently as possible while ensuring we don’t settle too quickly and leave money on the table.
Should I accept the insurance company's first offer?
Almost never. First offers are typically far below what your case is worth. Insurance companies make lowball offers hoping you don’t know better or are desperate for money. They count on you accepting before you understand the full extent of your injuries or the long-term impact on your life. Before accepting any settlement offer, have an experienced attorney evaluate whether it’s fair. Our consultation is free, and we can tell you honestly if an offer is reasonable or inadequate.
What if I didn't feel hurt right away?
This is extremely common. Adrenaline masks pain immediately after an accident, and many injuries don’t show symptoms for hours or even days. Soft tissue injuries, whiplash, and even some brain injuries have delayed symptoms. This is exactly why you should see a doctor immediately, even if you feel fine. You still have a valid claim even if symptoms appeared later, as long as you can prove the injuries resulted from the accident. Seeing a doctor right away creates a medical record linking your injuries to the crash.
Can I still file a claim if the police report says I was at fault?
Yes. Police reports are not the final determination of fault. Officers don’t always see the accident happen, and they sometimes get it wrong. We can challenge police reports with our own investigation, witness statements, accident reconstruction, vehicle damage analysis, and other evidence. An incorrect police report doesn’t mean you can’t recover compensation—it just means we have more work to do.
What is the difference between full tort and limited tort in Pennsylvania?
When you bought your auto insurance, you chose between limited tort and full tort coverage. Full tort allows you to sue for all damages including pain and suffering, emotional distress, and loss of enjoyment of life. Limited tort restricts your ability to sue for these non-economic damages unless you meet the “serious injury” threshold (death, serious impairment of body function, or permanent serious disfigurement). Limited tort offers lower premiums but dramatically limits your recovery. We’ll review your policy and explain exactly what coverage you have.
Will I have to go to court?
Most car accident cases settle without going to court. The vast majority resolve through negotiation with insurance companies. However, if the insurance company refuses to make a fair offer, filing a lawsuit and potentially going to trial may be necessary. If your case does go to trial, we’re experienced trial attorneys who will represent you aggressively. We’ll prepare you for what to expect and be with you every step of the way.
How do I pay for medical treatment after the accident?
You have several options: your health insurance should cover accident-related medical treatment; Pennsylvania no-fault benefits (first-party benefits/PIP) from your auto insurance pay medical expenses regardless of fault; many medical providers will treat personal injury patients on a lien basis, meaning they wait to be paid from your settlement; and Medicare or Medicaid if you qualify. We help coordinate medical treatment and billing so you can get the care you need.
What if the insurance company denies my claim?
Insurance companies sometimes deny valid claims, but that doesn’t end your options. We fight claim denials aggressively by gathering additional evidence, filing appeals through the insurance company’s internal process, filing a lawsuit to force them to cover the claim, and when appropriate, filing bad faith lawsuits against insurance companies that improperly deny legitimate claims. Don’t give up if your claim is denied—call us to explore your options.
Can I handle my own car accident claim?
Technically yes, but it’s rarely advisable. Insurance companies take advantage of unrepresented claimants who don’t know the law, don’t understand how to value claims, don’t have resources to investigate thoroughly, and can’t afford to take cases to trial. Studies show that people who hire attorneys recover significantly more compensation than those who handle claims themselves—even after paying attorney fees. The legal and insurance systems are complex, and mistakes can cost you tens of thousands of dollars.

What Clients Say
Mr. Pagano provided amazing service to me. He provided a holistic approach because he understood that my children were affected by the unfortunate circumstances. Throughout the process, he was attentive to all of my concerns as a client.
I should have left this review a long while ago. I was fighting a serious case in 2012. Its effects turned my life upside down. Mr. Pagano saved my life. The opportunities I have today would not be possible if not for him and his entire team.
Sarah jones helped me with my child support case. They kept running over me not listening to anything I said, taking more money from me until I hired Sarah. I told her my story and she took it from there and when it was time to go e I won all my cases. Just wanted to say Sarah Jones is no joke, she does a great job and I want to say thank u again Sarah.
