Pennsylvania has unique car accident laws that significantly impact your case. Understanding these laws is critical to protecting your rights and maximizing your compensation.

Pennsylvania’s Limited vs. Full Tort Insurance

When you purchased your auto insurance policy in Pennsylvania, you made a choice between “limited tort” and “full tort” coverage. This choice dramatically affects your ability to recover compensation after an accident.

What is Tort Insurance?

Tort insurance determines what damages you can sue for after a car accident. Most people don’t fully understand this choice when they buy insurance, but it becomes critically important after an accident.

Limited Tort coverage allows you to sue for economic damages like medical expenses and lost wages, but restricts your ability to sue for non-economic damages like pain and suffering unless you meet the “serious injury” threshold. People choose limited tort because it offers lower insurance premiums, but it can severely limit compensation after an accident.

Full Tort coverage allows you to sue for all damages including pain and suffering, loss of enjoyment of life, and other non-economic damages, with no restrictions. While it costs more in monthly premiums, it provides much more protection if you’re injured.

The “Serious Injury” Exception to limited tort allows you to sue for full damages if you suffered death, serious impairment of a body function, or permanent serious disfigurement. We can help determine if your injuries meet this threshold.

Statute of Limitations in Pennsylvania

Pennsylvania law gives you two years from the date of your car accident to file a lawsuit. The clock starts ticking on the day of the accident, and if you miss this deadline, you lose your right to sue forever, with very few exceptions.

Disfigurement and Scarring addresses the compensation you deserve for permanent visible scars, facial injuries that affect your appearance, and the self-consciousness and embarrassment that often accompany disfiguring injuries.

Punitive Damages (Rare)

Who Can Be Held Liable for Your Philadelphia Car Accident?

This is extremely common. Adrenaline masks pain immediately after an accident, and many injuries don’t show symptoms for hours or even days. You still have a valid claim even if symptoms appeared later, as long as you can prove the injuries resulted from the accident.
